Since economic globalization has gradually become the objective reality of the world,commercial bribery has also become a global thing, crossing gradually borders. To gain acompetitive advantage, main body of international market (multinational company,etc.)shows a lot of commercial bribery behavior, which has destroyed the fair competitionof international market economic order. The behavior, commercial bribery in internationalcommercial transaction, is named as "the overseas corruption" or "internationalcommercial bribery". To highlight its business purpose, the thesis has named it as"international commercial bribery". International commercial bribery have both the broadsense and the narrow sense: narrow sense of transnational commercial bribery is thecommercial bribery to the public sector by the private sector; broad sense of transnationalcommercial bribery includes commercial bribery inside the private sectors. This papermainly analyzes the special regulation of the narrow transnational commercial bribery.Governing the commercial bribery of transnational, the legal regulations are the keypoints. Because of the different degrees of hazard brought by the transnational commercialbribery from bribing companies to both the host countries and the mother countries, thisdissertation will analyzes the legal regulation of commercial bribery in the multinationalcompanies, from the perspective of his or her motherland and host country at the same timewith complementary of the international community, combined with the Baselmanagement model, based on our country’s current situation of legislation, correspondingmeasures are taken to break the plight of the multinational commercial bribery in China.
