On The Improvement Of Rural Legal Aid System In China

The legal aid system, as a system of judicial relief is an important part of the legal system of a country. Countries through appropriate legal aid scheme aim to ensure everyone including the social poverty and some of the special social groups have fair access to judicial protection and relief, and realize equality before the law. Whether to establish a sound legal aid system is not only an important symbol of measuring a country’s legal system soundness and judicial human rights protection mechanisms, but also a symbol of measuring a country’s social civilization and progress. The legal aid system in China started late but rapidly developed and is constantly improved, but this improvement is just relative to the urban area where the public service is sound. In fact, the rural legal aid system in China is still in the initial stages and needs improvement. The main targets of the legal aid are citizens in financial difficulty and some special social groups; therefore, the legal aid work should focus on rural areas. Construction of socialist new countryside is a major strategic plan of the CPC Central Committee building a socialist harmonious society. Sound and comprehensive rural legal aid system, is an important guarantee for building a new socialist countryside, maintaining social stability and building a harmonious society. In the context of the construction of new countryside, new agriculture-related disputes are increasing and things that infringe upon the legitimate rights and interests of farmers often happen. However, due to the imperfections of the rural legal aid system, most farmers can not get effective legal assistance in the face of the legitimate rights and interests being infringed, so they chose other extreme dispute resolutions, which frequently results in egregious cases in rural areas, and seriously affects the social stability and the building of a harmonious society. Therefore, further improving the rural legal aid system, strengthening the legal aid work in rural areas, meeting the farmers’ demand for legal aid have a significance to safeguarding the legitimate rights and interests of farmers, ensuring judicial justice, building a harmonious society and a modern socialist country under the rule of law. The text is divided into four chapters:Chapter one briefly summarizes the legal aid system, introduces the basic meaning of the legal aid system in the modern sense, the concept of the legal aid system in China, and analyzes the basic characteristics of China’s legal aid system.Chapter two briefly analyzes the reasons namely the necessity of improving rural legal system from safeguarding the legitimate rights and interests of farmers, realizing justice equality, building a modern socialist country under the rule of lawChapter three briefly analyzes the current situation of rural legal aid from farms’ attitude to legal aid, diversification of rural dispute resolution mechanism, local government’s attitude to legal aid, and then gets the problems.Chapter four briefly makes proposals of improving rural legal aid according to the problems of rural legal aid.
