Research On Civil Liability Of College Students Abnormal Deaths

In recent years, due to the improvement of higher education policy, the college expansionplan is increasing year after year. Therefore the abnormal deaths of college students show agrowing trend. The college students administration which is being questioned by the public andmany problems related to campus safety have become the focus of parents and all sectors ofsociety.The frequent occurrence of college students abnormal deaths not only bring tremendoussuffering to the student and his or her family, but also influence the regular teaching andadministrative order directly, and give rise to the unnecessary economic loss and side effect tocollege reputation. Deep study of related civil liability about college students abnormal deathsand further improvement of laws and regulation to deal with the college students abnormaldeaths are the objective requirement to maintain the transitioning college reform, steadiness anddevelopment, are the practical requirement to guarantee the students’ healthy growth and protectlegitimate rights, and the inevitable requirement to create harmonious campus and society, and toconform to the development of times.Academics mainly focus on handling methods of primary and secondary school studentsabnormal deaths, often overlook the theoretical research of the college students abnormal deaths.The research of civil liability of college students abnormal deaths is too scattered, lacks overallsummarization, comprehensive discussion and strategic study to combine theory and practice.Due to the deficiency of theories study, the handling methods are short of necessary guidanceand regulations, leading to increasing of judicial practice difficulties. The current legislationdocuments show low level of laws and regulations’ general efficacy, so the judicial professionalshave few authoritative laws and regulations for reference. In China there isn’t a special law toregulate the legal liability of the college students abnormal deaths, regarding to this, China hasfallen behind. On Sept1st,2002, Ministry of Education issued “Students accidental injurytreating methods”. Although it has sections to regulate students abnormal deaths, this methods’legislation level is part of departmental regulations, lower than the laws has high levels like “General Civil Law”. Hence the authoritative legislation is extremely urgent.Taking this into account, this paper will begin with case studies, analyze the related civilliability of college students abnormal deaths under different situations, give constructive adviceto several problems occurring among the civil liability of college students abnormal deaths andgive specific explanation of law improvement in order to help deal with the liability of collegestudents abnormal deaths effectively, maintain the regular teaching order, and create aharmonious campus.
