Research On Community Corrections Sentence Replace Public Surveillance

Control punishment is original punishment method in our country, belongs to the onlylimiting freedom penalty in our country, is also thought to be the lightest punishment systemprincipal punishments of our country. Its establishment conforms to the punishment in theworld today, the trend of socialization. Control in the early days after foundation ofpunishment in a stable social and political situation and fight counter-revolutionaries hasplayed a positive role, but in the development process, especially in1979and twice in theprocess of revision of the criminal code in1997, the abolition of control punishment for themis very fierce. Fierce battles in regulation punishment and waste, the author advocated theabolition of restrictions, though twice before and after the revised criminal code when keepthe regulation punishment, but there is no denying that due to the change of social regulationand punishment itself defects, lead to the applicable rate is very low, in the judicial practiceled to the decline in the position in the penal system. Therefore, pay more attention to thetheoretical research of regulation of punishment, to find alternative to other mitigation, is thesignificance of research, the writer and has very important practical significance.Community corrections sentence is court sentenced the defendant engaged in unpaidlabor in the sentence pattern is beneficial to a society, or outside take the punishment, alsoengaged in the work of unpaid punishment behavior.In today’s world of background ofhumanitarian, social, as a kind of punishment,community corrections sentence, in thedeveloped western countries, such as Britain,has widely applicable,but is still blank inChina.I suggest that community corrections sentence,as a kind of punishment,should bebrought in.In the same with public surveillance,they are both restricted freedom penalty.Using community corrections sentence to replace public surveillance, we are in order toimprove the punishment system and the value of penalty execution.This paper is divided into three chapters except the introduction and conclusion:The main content of chapter one is about the basic theory of community correctionssentence,firstly,I discriminate the two congcepts, community corrections sentence andcommunity corrections,and make a clear dividing line between them.Secondly,start with the basic theory of community corrections sentence, I elaborate theoretical foundation of the existof community corrections sentence.The main content of chapter two,I start with the intension of public surveillance,andelaborate the current situation of public surveillance.Then,as a writer,I espress my position,abolish public surveillance and use community corrections sentence to replace it.In the third part,I deep analyse the necessity and feasibility of using communitycorrections sentence to replace public surveillance and propose the concrete imagination inthe aspect of legislation, judicion and execution.
