A Study On The Role And Position Of Vietnam Lawyers’ Association In Making Law Of Vietnam

Vietnam Lawyers’Association was established in1955pursuant to the Decree No.130/NV/DC/ND dated April04th,1955. The Lawyers’Association is a polictical-social-occupational organization, an united and voluntary of the lawyers in the whole country and also the member of Vietnam Fatherland Front under the leadership of Vietnam Communist Party and the administration of Socialist Republic of Vietnam.Follow the operation purpose of the Association:It is the close connection with the cause of establishing the Socialist Republic of Vietnam. In the Vietnam’s current innovation, innovating the political system, establishing the Socialist Republic of Vietnam, enhancing the international integration require a lot of efforts of the entire polictical system, including the Vietnam Lawyers’Association. One of strategic targets is to promote the role of Vietnam Lawyers’Association in establishing the legal policy to deserve with the feature of an organization of Lawyers who operates in the fields of establishing, executing and protecting the law.Currently, Vietnam Lawyers’Association is facing the new chances and challenges. Estabilsing the Law in Vietnam has gained a lot of significant progress over the past time. The process of law establishment is executed more democratically; the quality of law document is enhanced more. The political-social organizations, citizens have got a lot of chances and conditions to contribute the ideas to the law establishment. With the nation’s current development, the role of the law and social institutions such as Lawyers’Association is given the attention. Many documents of the Party and State emphasizes the important role of Vietnam Lawyers’Association. In reality, many activities of law establishment, law education propaganda, legal support are assigned to Vietnam Lawyers’Association by the Party and Atate. The position of Lawyers’Association in the political system is strongly growing.Analyzing and evaluating the situation of legislative process in Vietnam and the participation of Vietnam lawyers’association in the legislative process recent time, the thesis focuses mainly on the following matters:Study current legislative process; situation of Vietnam Lawyers’association and agencies specialized in law participating in that process. Then, the thesis assesses efficiency, defects, shortcomings of current law regulations on legislative process; assesses role, objectively effective position of Vietnam Lawyers’association in legislative process.Proposing a mechanism in which Vietnam Lawyers’association can effectively participate in legislative process. Specify the proposal; give recommendations to complete relevant law, make an outline for basic content of Vietnam lawyers’ association regulations and participate in legislative process.The thesis uses synthesizing and analyzing method to clarify ability and capacity as well as shortcomings of Vietnam Lawyers’Association of their participation in stages of legislative process. Then, a solution for Vietnam Lawyers’ Association to promote their direct role of participating in the legislative process is proposed in order to supplement, complete and overcome current shortcomings in legislative process, strengthening legislation in Vietnam.
