The Research On Legal Regulation Of Private Financing

In recent years, with the rapid development of the economy and the implementation of the tight monetary policy, a shortage of social capitals arised, which made civil financing activities extremely active. In fact, civil financing has occupied a huge financing market share. On the one hand, it promoted social and economic development to some extent. On the other hand, it also caused the chaos in the finance market. Over the past few years, the number of disputes concerning lending problems at the court rose sharply, and there existed the chain reaction phenomenon triggered by falling from power of one person. Furthermore, the series cases became more frequent, which even suspected of illegally accepting public deposits and financial fraud. These cases fully exposed the flaws and loopholes of financing legal system in China, which seriously affects the stability of the local social and economic development, as well as the security and stability of our financial markets. So the improvement of private financing laws and regulations must be put on the agenda. Currently, the understanding of civil financing is different among the scholars in China. There are still many problems and shortages in theose systematic researches, which presented more identical, routine and popular view instead of reasonably original and prominent point. For this reason, it is necessary to study in-depth. This thesis topic is based on civil financing laws and regulations. First, This thesis studys the concept of civil financing and its historical development as well as lessons of legislation in foreign countries. Second, it analyses the existing form and characteristics of civil financing and summerrizes its problems and causes. Third, based on what this thesis studys, suggestions about how to perfect civil financing activities are put forward, taking into consideration the legitimacy and feasibility of civil financing.
