Corruption is a tricky task for all governments in the world. The system ofproperty-declaration by public servants named sunshine law is a fundamental system toprevent corruption, and the so-called anti-corruption sword is a popular anti-corruptionsystem in the world. Chinese system of property-declaration by public servants starts lateand falls behind. To date, no relevant legislations have been made. Therefore, no actualsystem of property-declaration by public servants has ever existed in China. Americansystem of property-declaration by public servants is a comprehensive anti-corruptionsystem constructed by U.S. federal government, which has been developed thoroughlyduring long-term anti-corruption by U.S. government. Based on the success of the systemof property-declaration by public servants in U.S.A., we hope to provide positivereference for the construction of the system of property-declaration by public servants inChina through investigating systematically the system of property-declaration by publicservants in U.S.A. The thesis is composed of3parts:The first part is a summary for the system of property-declaration by public servantsin the United States of America. In this part, the theoretical framework of the wholethesis is presented, which includes the connotation of the concept, the basic elements andthe principles of the system of property-declaration by public servants, as well as theessential connotation, the theoretical source and the main contents of the system ofproperty-declaration by public servants in U.S.A. The Ethics in Government Act presentsa framework for the system of property-declaration by public servants in U.S.A., and thetheory of “Conflict of Interest” is its theoretical source. Prevention of “Conflict ofInterest” is the basic rule for the design and implementation for the system ofproperty-declaration by public servants in the United States of America.The second part is the developing history of the system of property-declaration bypublic servants in U.S.A. The system has been explored for a long time. It has beenbrewed since1940s&1950s and it wasn’t legalized until1970s. It promotes theestablishment of incorrupt government, raises public servants’ moral level, and pushesthe development of American democratic politics. ;Finally, the thesis makes a comment on American system of property-declarationby public servants and draws some inspirations from it for the establishment of Chinesesystem of property-declaration by public servants. The distinguishing features ofAmerican system of property-declaration by public servants are legalization,standardization and its supporting measures. However, there are some defects inAmerican system of property-declaration by public servants during its long-term practice,which deserves deep thinking. Anyway, it is worth studying the advanced experiences ofthe system of property-declaration by public servants in U.S.A. With the development ofChinese economy and society as well as the deepening of anti-corruption practice,Chinese system of property-declaration by public servants that complies with the basicsituation of China will be established finally.
