Reseach On The Government Information Disclosure System

As the important content of the construction on democracy and the rule of law Government information disclosure is attached great importance. At presence there are68countries those have made laws on government information disclosure. On April24th,2007, the State Council passed government information disclosure regulations of the People’s Republic of China, which came into force on May1st,2008.the regulations’issuing and implement is an important milestone in the process of building of government information disclosure system in China. It effectively standardized and pressed ahead the government information disclosure work in China. However, Rome was not build in one day. China still has a long way to go on the way of construction and perfection of the system of government information disclosure. Since the research on the system of government information disclosure is not sufficient, some defects of some sort must exist in the concrete system construction. This paper mainly discussed the concept and theoretical basis. It approved the significance of the issue of the government information disclosure regulations on the construction of administrative construction of rule of law. It pointed out the defect in the regulation and put forward proposals on the perfection of the system of government information disclosure.This paper is divided into four parts:The first part started from the concept of government information and government information disclosure, defined the concept of government information disclosure. It drew a dear dividing line between the confusable concepts, which built the basis for the whole paper’s discussion. Then it analyzed the theoretical basis on the theory of jurisprudence and constitutional law, after which it affirmed the regulation’s significance and value.The second part analyzed all sorts of phenomenon and problems appearing in the process of government information disclosure in China.The third part analyzed the causes of the present situation of China’s government information, and pointed out the defect on theory and system construction.The last part put forward the proposals for the perfection of China’s government information disclosure system.
