The Study Of The Problem Of Natural Monopoly Industry Legal Regulation In China

Natural monopoly industry, providing the public product and the public service for the society, is closely related with people’s daily life. Concentrating mostly in the infrastructure and the public utilities, natural monopoly industry plays the pivotal role in the national economic security and stability. How to rule natural monopoly industry by laws has always been a hot question discussed in academic circle. Conventionally, in China, with the system of exemption from the Anti-monopoly law, where there is natural monopoly there is little room for anti-monopoly law. However, because of lacking the regulation by anti-monopoly law, it often appears operators’ abuse of their dominant market position, which aggrieves the interests of whole society. So it is imperative to regulate natural monopoly industry by anti-monopoly law and improve our legal regulation system.This essay analyzes the legal regulation system of natural monopoly industry in our country. It is divided into four sections.The first chapter, with a practical analysis of the natural monopoly industry, points out the problems in natural monopoly industry. It also introduces the basic theory about nature monopoly and its legal concept.The second chapter, by analyzing "Anti-Monopoly Law of the People’s Republic of China" and other related industrial regulations, summarizes the problems of the legal regulations of natural monopoly industry in our country. For example, the related articles in "Anti-Monopoly Law" are not clear. There exists legal conflict between general laws and special laws, and ambiguity of regulators’ authorities, and so on.Third chapter is an inspection among the legal regulations of natural monopoly industry in America and European Union. By analyzing profoundly characteristics of various regulations and measures, it provides some valuable experiences for the legal regulations of natural monopoly industry in our country.The forth chapter puts forward some suggestions to improve the legal regulation system of the natural monopoly in our country. We should perfect the legislation, accelerate the reform of the administrative system of natural monopoly industry, and improve the system of enterprise product pricing.
