Nowadays, tourism disputes are increasing with the rapid development of tourismindustry, especially tourism fraud which damages the tourism consumer rightsseriously.So regulating tourism fraud is the demand to develop tourism industry healthy.In view of the present situation of tourism fraud regulation, this article puts forwardopinions and suggestions from the theoretical and practical aspects. Firstly, throughanalysising tourism fraud concept, people can understand the features and elements oftourism fraud, to makes a clear definition for it. Secondly, outlining the phenomenonalof tourism fraud at present that exsiting our tourism industry, and elaborating thesubjective and objective reasons that lead to tourism fraud occurs.Then to analysistourism fraud’s harm from two aspects of the micro and macro.Again, pointing outlegal deficiencies on tourism fraud, as for tourism fraud legislation, our country lacksbasic law of tourism, the tourism law in the provisions of sections has not adapted to thedevelopment of tourism, and points out that China’s existing laws and regulations focuson the adjustment of tourism longitudinal legal relationship, hile on tour transverse legalrelationship adjustment shortcomings. Finally, give advice to consummate tourism fraudlegal regulation for drawing lessons from other developed countries or regions of theadvanced legislation experience. Because of tourism legislation is not perfect,publishing the fundamental tourism law is necessary, to improve the tourism speciallegislation, so as to modify the deficiency of tourism legislation.Strengthen our countrytourism regulatory system from two aspects of administrative supervision and socialsupervision.At the same time to improve our tourism executive mechanism, andestablish the trial court and tourism small travel disputes arbitration system, Finally itcan be better protection of the legitimate rights and interests of tourism consumers.
