With China’s rapid economic growth, the number of anti-dumping cases initiated byEU is growing fast. The object of the product has a expanding trend: the products underinvestigation shift from mainly low value-added textile, mechanical and electricalproducts to high-tech products. And the product under investigation is mostlyconcentrated in the key products of China’s exports, which largely affected the stability ofChina’s export growth.China wins the case of EU carbon steel fasteners Anti-Dumping Measures on July28,2011by the WTO Dispute Settlement Body. The WTO Dispute Settlement Bodysupports China’s position, finds that the EU’s anti-dumping basic regulations of Section9(5)(granting Individual Treatment to the Chinese exporters with certain conditions) doesnot meet the WTO Anti-Dumping Agreement, No.6.10, No.9.2and No.18.4, and Chapter16of the WTO agreement provisions. This decision not only a major victory on the WTOdispute settlement, more importantly, it means that the current trade regime of WTO tothe EU with unfair, contrary to WTO rules, the principles and provisions of the seriouscriticism, and forced a thorough revision. The EU must be made for emerging markets tounfair and discriminatory anti-dumping regulations, which will help to improve thecompetitive environment of Chinese enterprises in the international market; China has sofar in the WTO in favor of the largest law cases, is a major landmark event in the Chineseanti-dumping history.The anti-dumping investigation is in accordance with the international law, it isimpossible to completely avoid. The number of anti-dumping cases will not have aparticularly decline, even in2016, when the WTO member countries recognize China’smarket economy status. Even so, we can not give up any opportunity to fight for ourrights and interests, we have to comprehensive use the economic, political and legalmethods, fight for legitimate interests of China’s export enterprises, protect the safety of our industry, and maintain the international competitiveness of our enterprises.
