As an important blueprint to explain the national or regional strategy, clear the focus of government, guide the activity of market subject and direct the development of economic society, economic planning is the basis of governmental enforcement of economic control, market supervision, social management and public service. The reasonableness of economic planning and actual effect of economic planning enforcement has a great influence on interested person. The final achievement of economic planning depends on the power limitation of economic planning management subject and the right guarantee of economic planning interested person. The economic planning claim right(EPCR) is economic planning interested person’s claim right to ask the economic planning management subject (not) to make a behavior when the economic planning changed or abolished, with the purpose of interest guarantee. Different to traditional claim right of civil law, the EPCR is a right of new type, combined with substantive right and procedural right, which is used in the field of economic planning. However, the research on EPCR is difficult to meet the need. Under such a circumstance, it’s necessary to recognize the basic content and legal characteristics of EPCR and analyze its foundations and values, then realize the specific right system of EPCR:economic planning resumption claim right, economic planning remedial measure claim right and economic planning compensation claim right. With the basis of a profound understanding of EPCR we can perfect the EPCR’s remedy mechanism. Through the introduction of EPCR enable the reliance interest of economic planning interested person to be protected throughout the process of economic planning enforcement.
