On The Legalization Of Government Economic Planning

In order to accommodate the demand of social and economic development in China and promote the legalization of economic planning and based on the general principle of government and market,this paper studies the current situation of the legalization of economic planning in China and puts forward related suggestions for the legalization of economic planning followed by the research method of recognition of problem,analysis of problem and settlement of problem.Starting from the concept of economic planning,this paper makes a detailed analysis of related legal principles in economic planning,clearly defines the role played by government in economic planning and its responsibilities,hopes government properly handle its relation with market so that positive list of government can be established.Great importance is attached to the necessity of legalization of economic planning and existing problems.The first problem is excessive prediction of government for market leads to vast disparity between economic planning and practical situation in market.The second is that there is discrepancy in economic planning objectives from central and local authorities.The third is about public participation in the process of economic planning should be encouraged.The fourth shows a lack of stability in the implementation of economic planning.The fifth is about the separation of government’s economic planning and judiciary.The sixth is the departmentalization of the formulation and the practice of economic planning.By the analysis of causes of the aforementioned problems and the discussion of legalization path of government’s economic planning combined with practical experience of national economic planning,this paper gives following suggestions,that is,the legislation of economic planning at national level should be improved,the legalization of the practice of economic planning should be clarified,and at the same time,the mechanism of public participation in government’s economic planning should be enhanced.
