China’s Government Green Procurement Legal System Research

The "green purchasing"refers to the government procurement whichchoose those non-pollution, environmental-friendly services, and so asto save energy, protect environment as well as promote the sustainabledevelopment of economy.Nowadays,the government procurement system hasbecame an important and effective method to implement the sustainabledevelopment strategy of countries all round the world. Furthermore,itcould be concluded from the practice of" green government purchasing" thatit plays a very important role in stimulation of the green industry,improvement of the social public environment-friendly consumption ideaand forming a conservation-minded society.In2003, China promulgated Procurement law, which explicitly pointedout that the government procurement should be advantageous to thecountry’s economic and social development policy, includingenvironmental protection. In2006, China’s Ministry of Finance andAdministration of Environmental Protection jointly issued the first greenpurchasing list thereafter released the government purchasing listsseveral times. The green purchasing covered a vast field,and relevantinformation network of government purchasing as well as green resourcehas been reaching better steps. However, China’s government green purchasing system,due to a lack of relevant theoretical support, is stillat the stage of exploration,which results in an inadequate effect on thesaid system.There are some short comes in our country’s"greenpurchasing"system,i.e.difficulties in implementation of relevant lawsand regulations,different standards of certification of greenproductions,obstacles in information communication and a lack ofrelevant executive agents.It is clear that an establishment of legalsystem should be made as quick as possible. Thus,some suggestions forimprovement of our country’s legal system of "green purchasing",whichbased on China’s realities and experiences of that of some advancednations.Conceptions of "green purchasing"should be carried intolegislation of relevant laws and regulations.In order to have an effectiveimplement and reach expected goals,some measures should be taken in thedevelopment of "green purchasing",for example,improvement of enforcementof laws and regulations, improvement of relevant rules for implantationand certification and management system.
