The report from Southern Weekly that Nationaly Citibank of New York applied19business patents as early as in1996was causing an uproar in China mainland. This yearis the11th year since China’s accession to the WTO, instead of barriers of tariffs andadministration, the barriers of the intellectual property rights and other non-tarriff hasbecame the major problem we were facing. More cautious attitude should be takenwhen facing the contents of business method patent. There are two parts of it: we shouldactively carry out theoretical research for providing a theoretical basis for theestablishment of a scientific and reasonable legal protection mode and preparing tosolve practical problems that may arise in the patent examination; cautiousness isrequested in line with China’s actual situation and conditions to develop this patentprogressively.
