| National civil servants that are the carrier and executor of national public administration and social public management and the direct exerciser of public authority, plays an important role in each career of party and country. With the deepening of the reform and opening-up of our country and the continuous development of the socialist market economy, a number of civil servants have been engaged in going into business, apart from assuming government work, which has destroyed the order of market economy collocating social resources, contradicted the principle of market fairness and equal competition, bred power-for-money deals, damaged the image of the party and the government, and intensified social contradictions. Due to the influence of concept, environment, institution and other factors, although there are lots of laws and regulations on the prohibition of civil servants going into business by the state, which haven’t given play to the desired effect and authority, with its roots being that there exist many dysfunctions in the conflict of interest during the administration of civil servants going into business in China. Therefore, to eliminate the unhealthy tendency of conflicts of interest in civil servants going into businesses and to build a clean and highly efficient civil servant team, it must establish and improve China’s governance mechanism of the conflict of interest of civil servants going into business.At present, China’s governance of civil servants’ conflict of interest in business is still in its initial stage with immature theories and deficiencies in terms of mechanism design and practical operation, which is mainly manifested in insufficiency of the executive power of relevant laws and regulations on civil servants’ conflict of interest in business and lack of operability; transformation of government functions not in place, and deficiencies in the supporting system, including property declaration of civil servants not in place, lack of fair payment system, incomplete supervision system of civil servants and so on. This article, mainly adopting the approach of literature review and starting with the significance of proposing and researching civil servants’ conflict of interest in business, makes a systematic analysis of the domestic and foreign scholars’ current research situation and constructs the basic research framework of this article. The article firstly analyzes the theoretical basis of the governance mechanism of civil servants’ conflict of interest in business, and indicates the necessity of civil servants’ conflict of interest in business; then analyzes the status quo of China’s governance of civil servants’ conflict of interest in business and the reasons for insufficiency, and finally puts forward suggestions on perfecting the governance mechanism of civil servants’ conflict of interest in business:Strengthening ideological education of civil servants; preventing conflicts of interests for civil law,further transforming government functions; perfecting the correspondingly supporting system, improving the property declaration system, giving full play to the incentive function of payment system; improving system implementation,strengthening the supervision and punishment forces of civil servants. |
