Real estate agencies and practitioners emerged along with the transformation of government functions as well as the optimization of market economy in China. The real estate agencies as new economic entities played a more and more important role in economic activities. As one of the pillar industries in China, the real estate.industry was overheated in recent years. Real estate agencies are developed along with the construction of the market economy system. They are the natural outcome of the developing real estate industry and the important symbol of a mature real estate industry. The real estate agencies in China however are less mature compared with these in developed countries and in Taiwan region, especially in US. However, the real estate agencies in China are under progress due to the development of real estate market. There also emerged many problems which affected the development of real estate agencies and market economy in China in a negative way.Scholars have done researches in real estate agencies from various perspectives. A great number of excellent academic achievements have been made, being the theoretical basis for the development of real estate agencies in China. However, most of these researches fell into the category of economics and sociology, and provided corresponding solutions. Little research has been done from the perspective of law. The author believes that the lack of legislation causes the lagging behind and chaos of the real estate agencies in China, and it is very necessary to do research from the perspective of law.In this thesis, the author will analyze the problems occurred to the real estate agencies, discuss the illegal operations and the reasons behind. The author will also summarize and learn from the researches done by scholars from home and abroad, and from the legislation of US, Germany, and Taiwan region, and provide relevant solutions towards the illegal operations of real estate agencies through comparison and analysis.The thesis has five chapters.Chapter one describes the definition of intermediary, the definition, characteristics, role and effects of agencies. The chapter then describes the definition and characteristics, role and effects of real estate agencies as well as the legislation concerning real estate agencies.Chapter two analyzes the legal regulations concerning real estate agencies in foreign countries and Taiwan region. The author tries to find something worth learning by comparing between the legislation related to real estate agencies in China and in US, Germany and Taiwan region.Chapter three analyzes the development of China’s real estate agencies, legal regulations concerning real estate agencies in China and their defects which include the incomplete laws and regulations, imperfect market access regulation, incompetent staff, deceptive advertisement, false information, unfair contract, practitioners’absconding with money and so on.Chapter four offers several solutions for those problems mentioned above such as strengthening legislation, applying strict market access standard, improving staff competence, honoring integrity, perfecting information release system, standardizing contracts, improving consumer’s sense and capability of protecting their own interests.
