The System Of Justice Horizon, Phenomenon Of Right Conflict And Its Solution

The rights issue has been the major issues in academic research. However, research on the rights of our past is mostly limited to the field of law, other areas of research are rarely involved in the very interest. We usually understood right just in the legal sense, think that we have the right only in the law at all. In fact, since the Third Plenary Session, with the reform and opening policy comprehensive、widely and in-depth implement, the rights issues are increasingly prominent position in social life and intercourse, the gradual increase in the types of rights, the connotation and denotation of the rights quickly expansion. The rights of publicity, rights conflict and other issues also continue to highlight, and has become the hot issue of such a time of change.On the subject of rights, rights conflict always mean by the right to harm or affect the party to the conflict,it is not conducive to the protection and realization of the rights of citizens. For society, the conflict of rights means an established social system, the legal order is destroyed, the social justice will be missing, limited the development of civil liberties is not conducive to the harmonious development of social health. This paper attempts to study the theoretical issues of conflict of rights in the system of justice, in particular, find the reasons for the conflict of rights, the principles for a settlement of the conflict of rights, as well as how to resolve the conflict of good rights in practice, thus contributing to the good order and fairness and justice of the civil society environment for the development of the formation of man’s free and comprehensive development to create the conditions. In view of this, this paper first analyzes the concept of conflict of rights, it is the basis of this thesis research, set the scope of this study; Second, analysis the causes of.the conflict of rights, we set the solution of the conflict of rights laid;Third, elaborate the type and substance of the conflict of rights, it helps our clear the right to the external manifestations and the inherent nature of the conflict; Finally, the analysis of the solution path of the conflict of rights, it is the end-result of this paper is on rights understanding of the sublimation of conflict phenomenon.
