Farmers Rights Protection System Of Justice

Since the reform and opening up, great changes have taken place in rural areas in China. The living standards of peasants have also significantly improved. However, many new problems emerged in our modern time when the economic and political reforms have achieved a lot, especially the one that the major rights and interests of the peasants have not been fully and effectively protected. All these result from the lack of attention to justice and fairness in the process of the development of institution. It makes peasants in a weak position of the community as a whole. Moreover, the disadvantaged status of the peasants affects the application of their potential, thereby affecting the socio-economic development of the whole country. Now our country is in the establishment of the new era where the well-off society is being built, and socialist modernization is being greatly accelerated and a harmonious society is being constructed. At this time, how to fairly treat peasants' rights and interests has become the bottleneck of constraining China's socialist modernization. The status quo of the peasants' rights and interests and its reflection on the lack of certain institutions have aroused the attention of all people.Fairness and justice is the cornerstone of social stability. To protect their rights and interests so as to realize justice institution is an important orientation in the transition of the institutional development. At present, to emphasize the peasants' rights and interests is not only concerned with the peasants themselves but also the whole society. To protect their rights and interests is to protect the rights and interests of other subjects; to promote the development of the peasants is to promote development for all. The current specific requirements of the theory about all-round development of human being in Marxist philosophy are to safeguard their rights and interests, and to promote their development. The imperfection of peasants' rights and interests originates from the imperfection of institutional justice. The institutional injustice results from the imperfection of institutional justice. How to achieve institutional justice and protect their rights and interests to achieve institutional justice is a key factor in the protection of their rights and interests. Several aspects about this problem are discussed in the paper. Firstly, the reasons for the imperfection of peasants' rights and interests are analyzed in the view of the status at present, which result from the existence of the urban-rural dual structure and the injustice of institution under it. Secondly, the imperfection of the institution and injustice are reconsidered and criticized, on the basis of which the basic connation of institutional justice at present is further studied. Lastly, based on the study of the problems above, how to change the urban-rural dual structure and how to realize the renovation of institutional justice are discussed under the guidance of the Marxist theory. Moreover the ways to conserve and realize peasants' rights and interests are brought out. The discussions of all these problems have important theoretical and realistic significances in making all peasants equal; effectively protecting their rights and interests; promoting their development; building a well-off society and constructing a socialist harmonious society.
