As a company with protection of intellectual property, the abuse of intellectual property right has become a new problem. How to use the rules of competition law to regulate effectively such abuse is being a hotly-discussed issue challenging both the developed countries and developing countries.In the intellectual property rights related antitrust, there is no doubt that the European Community is one of the leaders in this field.So This thesis select the European Union for this study. The article composes of four parts as below:The first chapter is the based theories, fucous on the relationship of the monopoly and intellectual property. The purpose of this chapter is to illustrate that performance of intellectual property must be restricted by antimonopoly law.and discussed the conflict between the unified competition law of EC and various intellectual property laws of member states.The second chapter discusses the conflicts to resolve, the intellectual property rights in the regulation of established three principles,through the case to introduce each principle establishment,development process of our country, has a strong reference value.The third chapter is about the development of the legislation of EU competition law in restricting monopoly of intellectual property.This section introduces the current system of EU competition law.In view of analysis to the evolution of the legislation in regulating the abuse of IP, it helps us to learn the flexibility of intellectual property policy of EU competition law. The fourth chapter paid more attentions to our domestic legislation of IP related anti-trust law, and main suggestions are made.
