On The Boycott Initiated By Trade Association In China And Its Anti-trust Law Regulation

Industry Association is the main body of the third-party control of governmentmalfunction and market malfunction, the nature of the industry associations have the samebounded rationality, such as safeguarding the interests of the industry, and coordinatingmembers of the action can play an active role in the process of self-management on the onehand, and On the other hand may also have the negative effect of restricting competition.Boycott in the implementation process is often both positive and negative features, but it isa self-reliant means of implementation, and resist out of what the purpose ofimplementation is the key to decide the nature of boycott. But the Anti-trust Law of Chinaand the relevant regulations make only a limited response to the boycott of industryassociation, the regulations can hardly be practiced. From the collective boycott, thisarticle would classify the boycott whose main body of implementation is industryassociation, and the further analysis is about the double effects of industry association’scollective boycott behavior and the reason for the effects.and at last, in connection with theexisting gaps, this article would construct the system of boycott regulation in China in theframework of Anti-trust Law on the basis of foreign experience.
