Research On Some Problems Of Anti - Monopoly Regulation In Trade Association

Industry associations can make contribution to market competition. Onthe one hand, industry associations, on behalf of the industry, can negotiateabout the industry development with the government and avoid governmentunfair interference in market. On the other hand, industry associations collectinformation from the market, analyze data and make a report to the members ofassociation. In this way, members of association can meet the requirements ofthe market. On the other side of the coin, sometimes, industry associationsactually limit competition. I elaborate on manifestation of what industryassociations do to restrict free competition in first part of my thesis. Obviously,It is harmful. In the second part, I state legislation and enforcement ofantimonopoly surrounding industry association’s restrictive competitionbehavior. In the last part, I make suggestions on legal regulations of industryassociation’s Restrictive competition behavior. Three law enforcements areresponsible for industry association’s Restrictive competition behavior. Theydecide punishment on one case and make different punishment. I put forwardcountermeasures accordingly. Industry association made attempt to disguise hisoffences. So it makes great difficulties to investigations. It is necessary for ourcountry to operate a leniency policy whereby companies that provideinformation about a cartel in which they participated might receive full orpartial immunity from fines. We must make effort on the continued perfectionof leniency policy.
