Research Of The Confidentiality Examination System In The Publicity Of Government Information

As the core system of the construction of the open of government information, confidentiality review system directly determines the scope and extent of the open of government information, and embodies the construction level of the socialist democracy and the rule of law, advanced governing idea of the government and the national human rights security system and other aspects. Perfect, scientific, elaborate, and defined power-and-responsibility confidentiality review mechanism of the open of government information finds the solution to the difficult problems on the construction and practice of the open of government information system, and has the inevitably important role on perfecting the democratic politics, promoting the reform of administrative system, supervising the administrative organs in the exercise of executive power, preventing the abuse of power and corruption, and the realization of social resources sharing and the construction of the harmonious society of socialism.At present, although the relationship between the open of government information and national confidence conservation have caused enough attention from the domestic academia, and produced a series of research results, but the coordination and implementation between the "Regulations on Open Government Information" and the "Law of the People’s Republic of China on Guarding State Secrets" which was promulgated in2010(hereinafter called "the new Guarding Secret Law" in short) involves little. Therefore, in the case of less specialized research on specific matching system of the open of government information, this thesis attempts to systematically analyze the confidentiality review mechanism---the key mechanism of the open of government information system, taking confidentiality review system of the open of government information as the research content, to launch the elaboration and make the research combined with the "Regulations on Open Government Information" and the new Guarding Secret Law" and other relevant laws and regulations and related documents.The thesis carries out discussion by chapters from the aspects of the open of government information and the brief of the confidentiality review system, has a serious study on the theoretical foundation of the confidentiality review mechanism of the open of government information, draws lessons for our country from the comparison and analysis of the confidentiality review system of the open of government information system of the United States, Japan, Britain and other foreign countries, and also carries out discussion according to the current situation and disadvantages of the confidentiality review system of the open of government information in China at present. The thesis makes a discussion both on the meaning and characteristics of the confidentiality review mechanism theoretically, and combined with the practice of the open of government information since the implementation of "Regulations of the People’s Republic of China on Open Government Information", analyzes the important role of the confidentiality review mechanism on the work of the open of government information as well as of the inadequacy that still exists, and uses the method of comparative research to introduced relevant experience of confidentiality review in foreign countries, finally to propose the perfection idea of confidentiality review system of the open of government information in China, in order to promote the confidentiality review mechanism of the open of government information to better adapt to the national conditions in China, and promote the long-term development of political, economic, cultural and other aspects in China.
