On Improvement Of The System Of Chritable Trust Supervisors

Trust originated from Britain,but The Britain Charitable Trust is not defined thesystem of trust supervisor.Trust supervisor is introduced in Japan Trust Law.The TrustLaw of People’s Republic of China also provides the system of Charitable Trustsupervisor.But the provisions of The Charitable Trust supervisor system is too principleand simplistic,can not adapt to our increasingly well-developed public welfare.In thiscontext,author focused the study on how to improve our system of Charitable Trustsupervisor.The thesis is divided into four sections.The first part introduces essential theory about trust and charitable trust.First toelaborate on the basic concepts of trust,and then the thesis describes the legal system ofcharitable trust on the Trust Law of PRC. Finally the author points out the importance ofthe legal system of charitable trust in the Trust Law of PRC,which make you want toinprove charitable trust legal system from.The second part analyzed the need for improving our charitable trust supervisorsystem.It tells us the reality need of improving our charitable trust supervisor system.Itintroduces the defects of foundation run mode in China’s public welfare,which reflectsthe urgency to improve our charitable trust supervisor system.It also points out that theChina’s public welfare need to be perfected because the regulatory agencies of China’spublic welfare isn’t clear.In addition,the author specifically introduces the requirementsand the missing of the supervisor system of the charitable trust in the Trust Law ofPRC. The author mainly introduces the absence of rigts,powers, obligations andliabilities of our charitable trust supervisor,points out the lack of conditions of service,the inperfect of selection and dismissal,as well as points out the deletion of rules ofprocedure.The third part refers to the research of Extraterritorial Charitable Trust supervisorsystem.In this section,the author introduces the provisions of the common law ofEngland,the United States,as well as describes the provisions of the civil law systems ofJapan,South Korea and Taiwan region of our country. Examining the different legalsystems of countries and regions on the provisions of the Charitable Trust supervisorsystem,in order to be able to reference for the improvement of our charitable trust ofsupervisor system. The fouth part presents recommendations to perfect the supervisor system of ourcharitable trust.The author targets at the lack of our Charitable Trust supervisor systemand bases on the the different legal systems of countries and regions on the provisionsof the Charitable Trust supervisor system.The author designs the charitable trustsurpervisor system from the legal status,conditions of service,powers and rights,obligations and responsibilities, the selection,dismissal and the composition and rules ofprocedure.Look forward to a comprehensive improvement of our charitable trustsupervisor system,and promote public wlfare undertakings in China.
