The appeal for an honest and clean government, the fight on corruption and thecreation of a fair and harmonious atmosphere among society are significant for worldpeace and development. Nowadays, transnational corporations are main promotersof the mainly promote economic globalization, which also triggers intensecompetition among transnational corporations in the global market. Conductingcommercial bribery has become an important meanthrough which transnationalcorporations seek for more benefits. This phenomenon has spread around the world.The currently aggravated commercial bribery has become a global issue that attractsmore and more attention. It is also a prevalent form of transnational corruption.Based on “United Nations Convention against Corruption”, the existing internationalanti-corruption cooperation mechanism is comprehensive and holistic, but it faces theproblem of weak enforcement. As a result, it is difficult to contain transnationalcommercial bribery effectively. The main reason is that sovereign states haven’t builtenough consensuses on the degree of sensitivity and vulnerability In terms oftransnational commercial bribery. Rio Tinto "spy gate" case has revealed again theincreasingly severe transnational commercial bribery China faces, but it also providesa new start for China to confront transnational commercial bribery in a legalperspective. However, compared with international anti-corruption cooperationmechanism, China’s legal counterpart on commercial bribery has many flaws, whichgreatly weakens China’s efforts to fight with transnational commercial bribery.China should learn from the advanced international anti-corruption cooperationmechanisms, to improve its domestic legal system on containing commercial bribery,and to involve itself more actively in international cooperation on anti-corruption andlegal construction process.
