The Research Of The Crime Of Infringing Copyright In The Age Of Internaet

With the coming of the internet age, the copyright which is closelyrelated to the development of transmission technology has taken profoundchange by itself. At the meantime, the infringement of copyright presentsa high crime rate with the characteristics in a wide range of subject ofcrime, diversified forms of crime, technological infringed right andindistinguishable consequence, which can lead to suffering manyproblems and disputes in current legal practice and restricting theprotection of copyright under criminal laws. On the basis of study andcomparison on the difference between the infringement of copyrightunder the age of internet and the traditional infringement of copyright,this paper provides an analysis of several issues concerning the intentionof crime(’the purpose of making profits"), objective behavior(“reproduciton and distribution") and the subject of crime (“intenretservice provider") in infringement of copyright via internet in accordancewith the present judicial situation and the latest authoritative judicialinterpretation. This paper attempts to clarify the constitution of crime and put forward the corresponding measures in order to provide a betterguideline for the legal practice against the infringement of copyright ininternet and build a nice atmosphere of culture in society.
