As the leader of new technology, genetic science and its prospects has been related to the well-being of all mankind. Especially for China:such a country who is going through an extraordinarily rapid of high-technology. Genetic technology is likely to become the first area of linking with the developed countries. As a core component of this field, gene sequence should be researched to promote the progress of entire genetic industry. However, it is gradual leading to a trend that genetic disciplines would no further get in touch with other areas of society:all because of the increasingly accelerated pace of technological upgrading. In addition, genetic industry is the special one which with high risk and retaliation at the same time. So it is hard to choose a value type of the genetic development. Moreover, gene sequence is the fundamental form of genetic material. Once becoming the commercial use,it will involve a number of social problems which include public order and level things. Therefore, people began to wonder the need of intellectual property protection, or how to protect and its extent. Such questions has become the hotest topic over the world.This paper is divided into three levels:First, to explain the basic concepts and core content of gene sequences,and compared with gene technology and bio-diversity. Making a conclusion that why should people protect genetic resources in the name of intellectual property;Then focused on the characteristics of various protection methods. Making a detailed analysis on feasibility of elements which includes copyright and patent protection, and pointing out the author’s own view after discussing the hot issue;Finally, learning and absorbing legislative achievements from those developed countries based on Chinese current legislation, and then making out some gene-related recommendations to adapt our industrial development.
