How will law adapt it when medicine developed? In face of the gene-related patents fight, the deep and comprehensive research of how to perfect the law environment of gene-related patents protection will be our problem in a long time. Therefore, the study of intellectual property in the development of Bio-Medicine has become more and more important and urgent.In part I , the development of patent system, which reflects the working condition of patents in Chinese, is interpreted. It summarizes the condition of medical intellectual property with horizontal and vertical contrast, finding the problems existed, based on this, it describes the causes from the consciousness, policy, organization, procedure and cost of application, power of enforcement; Furthermore, this paper provides the suggestions for protection, such as enhancing the consciousness, perfecting the organizations et.In part II, in background of unprecedented opportunity and new challenge of human society, given by the rapid progress of bio-gene technology, we contrast the development of bio-economy in door and out of door. Then, we explain the development and character of bio-technology patents, and analyze its impossibility of patent on example of gene-related patents protection.In part IE, from the reality in our country, it is firstly pointed out that, compare to the developed countries, the disparity of our academic and technical research about gene is obvious and increasing, at the same time, the publication of the application about gene-related patents only have the rights of "temporary protection".
