Small and medium-sized enterprises (SMEs) play a very important role in bothdeveloped and developing countries, in enhancing economic development, drivinginnovation and competition in many economic sectors and maintaining social stability.Currently, in foreign countries the in-depth research on legal problems concerningSMEs has been with great achievements, and covering wide scope. In developedcountries, it already has a solid legal base for the promotion of the development ofSMEs.In China, SMEs contribute substantially to the steady and robust economicdevelopment, social security, and the strategies of developing China through scienceand education. However, due to its weak economic strength and scarce social resources,SMEs are in a very disadvantageous positon in market competition. In order to ease theconstraints faced by SMEs, the government needs to provide a fair market environmentand more market access opportunities, especially a stable and all-round legal contextand legal rights for the healthy development of SMEs.This paper studies the legal guarantee and support for SMEs on three aspects,mainly market access, financial and taxation policies and loan guarantee programs,suggesting government control policies to facilitate the free market access, tax reduction,and ensuring adequate lending and facilitating loan applications for SMEs. From the study, the author hope to make little contribution to the perfection and consummation ofthe relevant legal systems for the development of SMEs.
