Human culture can be divided into three categories including material culture, mental culture and institutional culture. Music and law are the important part of mental culture and institutional culture respectively. At the age of the national pastime, music is no longer a member of the sacred temple of art, but a thing related to our sensory pleasure, which is far different from the past. There is a developing process in human’s mental world constantly from production, development, recession to extinction. Similarly, music, as a spiritual creation of human, has also experienced such kind of process in the history. Each stage is with conspicuous musical style, new-created instruments and different manifestation of decline. For instant, Middle Eastern traditional, Judaic intonate, Christian chant, secular pastoral, renaissance new tune, baroque musical form. All of these represent different thoughts and philosophy. Interestingly, different musical forms and styles are almost corresponding to different penalties.At the beginning this paper studies some relationships between temperament and thought, temperament and moral, music and social order which are referred in Yue Ji. Then it focuses on baroque music and the reform of capitalist penalty. The historical proposition that the technology development of music, to some extent, impacts the development of criminal law can be concluded through considering whether there is a connection between artistic philosophy and the philosophical foundation of penalty. Ultimately, make a try to discover a new method of solving criminal problems in the perspective of the evolution of musical philosophy and musical style. It means that to prove and then use a rule of change in the musical area to examine and predict our criminal justice system.
