| In recent years, the number of both patent applications and authorized patents of China’s pharmaceutical and bio-pharmaceutical industries continues to grow. From the perspective of patent examination and patent authorization,60%of chemicals patent application that entered the substantive examination process has been granted; nearly60%of the Traditional Chinese Medicine (TCM) invention patent applications were approved. Enterprises are placing greater emphasis on patents and their patent strategies so as to protect its products and markets, which also lead to conduct research on enterprise patent strategy. Drawing on existing patent strategy research methods and from the perspective of patent text, this paper selected a representative TCM pharmaceutical enterprise of China and studied the TCM invention patent strategy of the last10years by reviewing literature, doing case study, searching patent and conduct ing s tatistical analys is. From four levels of analyz ing including overall distribution of patents, association between various ethnic groups of patents, and internal const i tute and typical cases of particula rethnic groups of patents, this paper analyzed disclosed technical information and scope of protection of patent text so as to:1Study patent application strategy, analyze and evaluate its original conception and legal thought that it embodied;2Study the internal constitute and association pattern of technology programs among various ethnic patents and evaluate results of patent application strategy along with analyzing authorized files and legal states;3Base on previous study, identify factors that impact the effects of patent strategy;4Following the preceding three studies, evaluate the overall patent strategy of the enterprise comprehensively.Therefore, we can produce reports on patent application strategy for the enterprise which is analyzed in this paper and provide a set of appropriate research ideas for TCM patent strategy research. |
