Ecological progress is the historical trend of the development of human civilization, which emphasizes the protection of nature and respect for the laws of nature, and focuses on the interdependent relationship between man and nature so as to achieve the harmonious coexistence of man and nature. People are the principal part of promoting ecological progress, meanwhile it requires public participation in a comprehensive way. In our country’s legal system, public participation and its system are far from perfect and mature. Therefore, structuring a legal system for the public to participate in promoting ecological progress serves as an important and significant role for the promotion of China’s ecological progress.During the process of the promotion of China’s ecological progress, environmental protection is the field that needs public participation most. Thus the public participation system and the specific legal system must be undergone research and design so as to give full play to the role of the public in promoting ecological progress. Ecological progress is a process that on the basis of fully understanding and respect nature, human can reuse nature for the benefit of mankind, and the total achievements gained in the process of building harmony with nature. The promotion of ecological progress means that human take up a culture-oriented attitude towards nature with no savage and manhandled way of development, and build a favorable ecological environment with carefully protection and actively promotion; and make ecological progress penetrate into the social structure with the aim of preventing human activities bring even the minimum damage to nature and implementing the promotion of ecological progress to some extent. Public participation refers to the public in accordance with relevant laws and regulations and rules enjoying the equal right to participate in all legal activities related to their environmental benefits, and the principal participating part mainly contains citizens, government and organizations. The scope of participation includes:legal activities related to environment during the implementation of the several stages, such as legislation, decision-making, supervision and relief. Its purpose is to ensure that the public have the rights to participate the various legal activities in promoting ecological progress, which facilitates the public’s protection for the ecological environment and the preservation of public environmental interests.Legal system for public participation in promoting ecological progress should includes:environmental information disclosure system, system for the participation of environmental legislation, system for the participation of environmental administration and environmental rights and relief system. Through analysis and research on the current legal system for public participation in promoting ecological progress in China and compare and reference from that of the foreign countries, it’s easy for us to find that public participation in China’s legal system is far from perfect. Of public participation in China’s legal system, some defects are:decentralized legislative stipulation, insufficient incentives, imperfect environmental information disclosure system, too narrowed scope of participation, Legal protection of the environmental NGO are defective. For these reasons, the formulation of the Environmental Education Act is needed to clearly define environmental rights of citizens and increase the intensity of environmental information disclosure, as well as expand the scope of public participation. The environmental NGOs system must be security, and the environmental public interest litigation system must be perfected as well. All these efforts must be made to improve China’s legal system for public participation in promoting ecological progress.
