Study On Legal Issues Of Rural Environmental Pollution And Measurement:a Case Study In Guangdong Province

In recent years, with the development of social economy, Chinese rural environment pollution problem has gradually become the bottleneck of agriculture and rural development. With the high-speed development of economic, Guangdong province, the developed areas of China, shows environmental deterioration, especially extensive heavy metal pollution, the highlight non-point source pollution, and serious water pollution problems in the rural land. The gradual worsening of the condition has already seriously affected the daily life of rural residents and the durable development of agriculture. It also has affected the sustainable development of the rural society. Therefore, research of the corresponding legal problems should be put forward. The countermeasures obtained can promote rural sustainable economic and social development in Guangdong and further enrich rural environment pollution control theory.Firstly, in this study, theory basis about Guangdong province rural environment pollution control have been studied. The relevant economic theory, cost and income theory, environmental Kuznets curve, externality theory and Carl-hicks improve theory have been employed; the relevant legal theory mainly:the right of citizens’ environment theory and Environmental Justice; as well as environment theory:sustainable development theory, ecological value theory, and public goods theory.Secondly, I perform an empirical analysis about rural environment pollution state of Guangdong province, and the causes of environment pollution of Guangdong province deeply has been pointed out:insufficient understanding thoughts, urban and rural structure, and faultiness of legal protection system. The analysis of the four solvable ways (financial investment, government requirements, environmental protection law enforcement, and education results) indicates the law measure is the best way of rural environment pollution prevention of Guangdong province. Promising suggestions about the legislation countermeasure have been proposed based on environmental protection law enforcement, environmental protection criterion obtained from the good experiences of the USA, Japan and Indian.
