In recent years, following the implementation of energy saving and emission reduction polices in China, China's power industry has seen a phenomena on the restriction of the electricity supply. Some people think that the Government's energy saving conducive to scientific development. Power limitation is understandable, because it is the stage of short-term emission reduction targets; and others with a view that the restriction of the electricity supply at the expense of people's livelihood, which deviated from the core purpose of energy saving and the requirements of the concept of scientific development. Therefore, it is necessary to start at the level of analysis of the legal system.In this paper, the method of the empirical analysis is used. By examining the entire process of events to limit power supply in Anping, Hebei Province, the authors analyze the problem of the legal system in the event. Furthermore, the author analyzes the root causes of the phenomenon of limiting power supply in electricity enterprises in China; in the legal perspective, the author analyzes the realistic contradiction of our energy reduction policies and policies to improve people's livelihood and put forward some policy of coordinating the relationship between the two areas. Paper is divided into four parts:Part I: Analysis with the method of the empirical analysis is used in the whole process of electrical events in Anping. First of all, by reference Anping presentations and reports about the event on the network, the author analyzes the background of Anping event. Web survey method is used to understand the event around the country to limit power supply after the promotion of energy saving policies. And to limit power supply is not an individual case but a problem in electric power enterprises.Part II: Legal problems reflected in "power brownouts events" in Anping were analyzed. They include: the procedure of concluding the emission reduction targets is defective. System and planning in energy conservation and emission reduction is enough and the appropriate procedural norms are lacking. No differences in the limit for the reduction are clearly illegal. Public participation in energy conservation programs in the protection system is lacking. And energy conservation in the economic regulatory framework and coordination mechanism is not enough. Part III: British and German experience in the advanced system of building energy saving system to be analyzed to draw our energy reduction that can learn from, which is used to build support for the work of energy saving system. Among them are mainly for reference system energy saving and emission reduction legislation, technical standards, the tax system, emission fund system, emissions trading system, incentive measures, etc.Part IV: By combining the scientific development concept, the author presents the legal system to solve the problem of energy saving in the event, which is to limit power supply, including: the system specification process of setting goals should be sound, and emission reduction target should be scientifically formulated. Government's macro-control system should be built. Market mechanism that will help the system should be established. Public participation in energy saving system should be established and the details of specific implementation need further improvement. Energy saving and improving people's livelihood should be coordinated. Coordination system of them should be built. Bring the scientific development of energy saving results should be shared to the public. |
