The Research On Reform Of China's Rural Land System

In recent years, the problems of rural land disputes,peasants losing field,violently demolition are becoming more and more seriously. These problems are not only influence rural development, but also cause widespread concern from government and academic circles. Most of these problems are caused by defective countryside land system in rural China. What are the problems of present countryside land system, and how to solve the problems, become the key subjects to academic circles.Base on existing academic research, integrate the science of administration management,governance theory and the science of public relations and so on, This paper points out the problems of present countryside land system, and puts forward the corresponding perfection measures.First, give detailed considerations on countryside land system and corresponding theories, make clear the concepts and theories of this research, discuss the basic countryside land system and the necessity of innovation vividly,Second, base on the theories and social practice, this paper explains the problem of countryside land system, and points out that the main questions are fuzzy land property, unclear subject and unstable contract period of the land use contracts, ill-formed land transfer mechanism, seriously violated the rights of the farmers by land expropriation, seriously land financial thinking of local governments, unsound land administration system, and unscientific plan of land utilization and so on.Thirdly, analyze the reasons of these problems, which are unreasonable legislation, unscientific design of the system, deviation of governments'political ideal, ill formed administration system, inner political and economical interests of governments, and realistic urban-rural dichotomy and so on.In the last place, this paper brings forth countermeasure for dealing with these problems, make clear that we must protect farmers'interests primarily, and we also have to pay much attention to the development of our social and economy. So we should take the following steps to make the reform of rural land system achieve good results. First, clear-cut the rural land ownership subject and their rights, and give legal protection. Second, stabilize the rural land contract and management rights. Third, perfecting agricultural land-use control system, and regulate rural land market order. Fourth, improve the rural land requisition--compensation system. According to different conditions, we should reform the management system of the household register and improve the rural social security, Play their respective advantages and complementary functions to solve problems effectively.
