The Alienation Of Our Emotion TV Programs And Its Legal Regulation And Control

With the development of China's television, more and more various TV programs are showed on the TV screen which including emotion TV programs. Emotion TV programs which encouraging and cultivating the audience to a certain degree show the beautiful feelings of human being and it helps to establish a good social order and shape a fine social atmosphere. However, emotion TV programs begin to show the phenomenon of alienation in recent years. There are a lot of problems in this kind of programs including not only materials, expressions, authenticity and media's role definition but also the violation rights of citizens, that is right of reputation and privacy. Our TV media belongs to the state property in terms of its system and composition of assets and the TV resource is rather limited, therefore, the existence of massive emotion TV programs with alienation will surely cause the improper exploitation of the public TV resource. In addition, the alienation of emotion TV programs make against the construct of our rule-of-law culture.The underlying reasons of emotion TV programs'alienation lie in that the social function of our TV media cannot be achieved normally. The supervisory function of the media which should be the most important social function is weakened and its place is overstepped by entertainment and profit making. At the same time, national public power which was the core of supervision gives way to individual privacy. The reason why media can not and dare not supervise national public power is that our legal system on right of press freedom is not well organized. The protection of our right of press freedom derived from constitutional review and litigation and there is no specialized press law stipulating right of press freedom, so media's right of press freedom cannot be protected and relieved effectively once the situation of violating right of press freedom happens. It is because of the imperfect of our legal system on right of press freedom, our media cannot play a role in supervising national public power and cause the alienation of emotion TV programs eventually.Under our present legal system on press freedom, we could manage the alienation of emotion TV programs by means of law governing, executive supervision and media self-discipline. In the process of managing, we should band every means together organically, draw upon the strong points and exploit the advantages of every management means to the full to make emotion TV programs get back on the right track and develop in a healthy way.
