Microfinance was initially as a new kind of poverty reduction in the international arena can be described as unique, sought after by many scholars and experts. If counting from1981, microfinance's development in China is more than30years, from poverty alleviation concept in the initial to the present economic and social aim. The development of microcredit in China has been well received by the government. For many years in the Central Documents,. The problems about regarded rural financial reform, rural economic development, increasing farmers' income has been in a very prominent position in the Documents. An important effection of micro-credit is to make the low-income farmers out of poverty. Practice has proved that it is impossible to rely solely on the Government's policy.China's microfinance development has not yet made satisfactory achievements, far from being like other developing countries as a vibrant new industries or sectors. There are two main reasons, First, micro-credit itself is flawed, which everything can not be perfect. Second, the environmental problems of microfinance in China. The market economy is the economy of the rule of law, as a financial innovation, we must take the legalization of the road. How to take the legal road is a big research project. But what is certain is that the rural microfinance legalization process will encounter various problems, How to solve these problems is the focus of this study, such as hard loans to the farmers, the efficiency of credit institutions and follow-up funding of rural microfinance institutions.It is usefull to find out the fundamental problems in the microfinance.As a way of poverty alleviation, microfinance is more than a financial innovation. Its inherent nature is not a charity fund, but to gain commercial profits and takes a commercial operation in order to achieve the sustainable use of funds. This determines that if we want to develop rural micro-credit, we must follow the path of legalization. But the legal system cannot be achieved overnight. We must use legal means to optimize the development of the legal environment of our rural microfinance with the reality of the actual development of microfinance in China. As a result, it is very important to find out the legal issues and vulnerabilities at this stage of microfinance development process in our country.In this paper, we make the legal issues that exist in the rural microfinance development as our object of study. On the basis of the in-depth analysis of the concept and characteristics of rural microfinance, we studied the legal relations in the rural micro-credit relations. By analyzing the development of rural micro-credit legal regulation, such as the embarrassing legal status, loss of relevant legal norms and low exponent bit, Supervision of the relevant bodies of confusion, we find out the legal issues, and make a deep analysis. Ultimately, we provide a valuable reference for problem solving.
