Legal Regulations On The Social Responsibility Of Transnational Corporation

With the development of economy and improvement of civilization in China, both the government and the masses focus more and more on transnational corporations'performance on their social responsibility; therefore, it's necessary for domestic legal professionals and scholars to think more and study more. This thesis's main purpose is to fully and detailedly introduce the relevant information about legal regulations for the social responsibility of transnational corporations at home and abroad. It emphasizes on proposing legal opinions for the social responsibility of transnational corporations in China to help the relating legislation, law enforcement and judicature. Except Chapter One of Introduction and Chapter Six of Conclusion, the main part in this thesis can be divided into four chapters:Chapter Two gives a brief introduction of transnational corporation's social responsibility. In this chapter the author, comparing and analyzing different views, explicitly defines the social responsibility of transnational corporations, analyzes the historical background and causes for its appearance, and introduces transnational corporations'practice of social responsibility in their mother lands and host countries.Chapter Three focuses on the law science's fundamentals of transnational corporation's social responsibility. In view of the former studies which emphasize more on practice than theory, the author makes some improvement in this chapter and discusses the legal background and nature of transnational corporation's social responsibility from jurisprudential perspective.Chapter Four shows the legal regulations for transnational corporation's social responsibility in the international community. From the level of national law and the international law, this chapter induces and analyzes international community's legal actions as well as the relevant status of transnational corporation's social responsibility. It also points out the existing defects and shortcomings.Chapter5displays author's consideration on the legal regulations of the social responsibility of transnational corporations in China, which is the key point in this thesis. Through collecting the large number of materials and cases, the author dissertates the status quo and weakening of transnational corporations'social responsibility, and analyzes further the reason for this weakening. Based on this analysis, responding policy is presented that the legal regulations for transnational corporations'social responsibility should be strengthened.
