The Existing Problems And Solutions Of The Financial Regulation In The Point Of View Of The Administrative Law In China

The financial industry, having strong relationship with the national economy, is the core engine of the modern world. Maintaining the financial system security is the most important issue for each country. At present, with the global financial crisis becoming increasingly fierce and spreading to substantial economy progressively, efficient financial regulation and stable financial system have already become the various countries'focus.The financial regulation is an administrative activity, used as a tool to regulate and restrict financial institutions and activities. The purpose of this article is to analyze the current situation and the development of the financial regulation system in the point of view of the administrative law. Meanwhile, with our country's financial environment and the background of the legal system, it gives some advices to the financial regulation system combining advanced experiments of the international financial market regulation. The first chapter mainly states the concept of the financial regulation, history of the financial regulation in China, the chosen regulation mode, the meaning and principle of the financial regulation law. The second chapter, from the empirical analysis, discuss some problems of the financial regulation in our country which containing the regulatory authorities'qualification and the legal status, the blurring duty between regulators, lack of the effective supervision, flaws of the financial supervision legal system. The third chapter proposes a way of the administrative law to deal with problems of the financial regulation, which including how to repositioning the standing of regulators, perfecting the regulatory functions, transforming to functions supervision from institutions supervision, establishing and completing the macro supervisory mechanism, perfecting the financial supervision law system, maintaining the financial system etc.The financial system is the economic foundation. Through the administrative law analysis, some suggestions are proposed to establish scientific, complete and efficient financial regulation law system, which in order to maintain our country's financial system and neutralize the influence of the financial crisis. Eventually, the socialist market economy could be safeguarded and developed.
