| Right to adequate housing as an important part of the human rights, is the right of human to obtain affordable and suitable human habitation, which with good facilities and basic services, safety, health, dignity and not to subject discrimination. Realization of the right to adequate housing plays a crucial role on the human survival and development, and also the most basic care of human.This paper starts from basic concept of the right to adequate housing and introduce the housing security experiences of developed countries and regions. This paper combine China's housing reform and founding history with the current defective and restrictive factors in realization of housing rights ,from the legislative protection, policy security and judicial protection tree perspectives to Construct China's housing security system. The first chapter is the basic theory of the right to adequate housing. First, from the basic concept of the right to adequate housing introduce the main subjects and contents of the right to adequate housing and compare the right to adequate housing with habitations analyzing the links and differences between them.The second chapter is the protective status of the right to adequate housing of mainland China. From the process of housing reform in China, this chapter analyzes the current situation of affordable housing, low-cost housing and Price of commercial housing, and consider that housing legislation is imperfect, housing policy change frequently and housing supply singly is the important restrictive factors of the right to adequate housing protection.The third chapter is the current status of the right to adequate housing in developed countries and regions. From the housing finance system, financial system and management system, this chapter introduces the U.S., UK, Singapore and China's Hong Kong legislation and policies which relate to the right to adequate housing, and consider that implementation plan for a planned housing, special housing management agencies, combination of market and government housing supply model and comprehensive legislation of above areas are greatly needed in China.The fourth chapter is the construction and improves of the right to adequate housing security system in mainland china. From legislative, institutional and judicial aspects, this chapter put forward tentative ideas to perfect the security of the right to adequate housing, and consider that multifaceted, multi-angle and wide-ranging measures jointly promote housing support is the necessary way to solve existing housing problems. |
