Research On The Copyright Problem Of Digital Library

The digital technology changes the mode of works'transportation, it promotes the convenience, efficiency and extent of transportation, these leads to the emergence of copyright of digitalization and right to network dissemination of information. However, on the one hand, the authors gradually lose the control of their works due to the convenience of infringement, the difficulty to supervise, the limitless of vigor and power, on the other hand, the users can't get license from copyright holders with low price and high efficiency. These two aspects had been the bottleneck and hampered the works'transportation.The large numbers of disputes for Digital Library are just the representation of the contradiction. For Google Digital Library and other Digital Libraries, the key to solve these disputes is how to obtain license from the copyright holders conveniently and efficiently.This is just the premise for the article, the article begins with three typical cases about Google Digital Library, which d educe the main problem of the article. Then in the second part, the article makes a overall introduction to the Digital Library and Google Digital Library's concepts, properties, characters, functions and construction status. In the third part, the article analyzes copyright and right to network dissemination of information,which are the main problems that Google Digital Library met in copyright area. In the fourth part, the article put forward that the key to the problem is how to obtain licenses of mass works, and makes a research about the license patterns already existed, the license patterns available to exploit as well as the license patterns now adopted by Google Digital Library, then give my opinion about the license patterns that Google Digital Library could adopt. Finally, in the last part, the article summarizes what opportunity and challenge the Google Digital Library brings up, and the attitude our Chinese should insist: the openness in the base of vigilance.
