Legal Research On Reform Of Property Rights For State-owned Monopoly Enterprises

The stated-owned monopoly enterprises have four characteristics which are Combination means government and stated-owned monopoly enterprises meet so closely as almost to merge, Enforcement means stated-owned monopoly enterprises exploit policies national law and administrative regulations to maintain benefits, Illegal means economic behaviors of the stated-owned monopoly enterprises break the national law or the administrative regulations, and High Profits means the stated-owned monopoly enterprises always generate high profits. The causes of the stated-owed monopoly enterprises is the property right, in order to eliminate monopoly the efforts should be made to carry forward reforms of the property right and strengthen the market competition.There are four sections in the paper. The first section is about types of the enterprises. The paper analyses the characteristics and causes of the enterprises, takes the origin and type of distribution of benefits into consideration, and indicates the harm of the enterprises. The reason for appearance of the enterprises is abuse of property rights. The structure of property rights makes the enterprises inefficient and the market uncompetitive. The second part is about the foreign enterprises. This one takes the reform of the enterprises in abroad for examples and analyses the affection of the reform. The third part is about the enterprises in China. Firstly the paper analyzes the present situation and problem of the property right. Then take a review of the reform of the enterprises in China and anti-monopoly control legal framework. The fourth section is about reform of the enterprises. The paper set a parallel coordinate piecemeal reform to change the structure of the enterprises' property right. In order to maintain the stability of economic, the reform of property right and strengthen the market competition should be in conformity with the law.The paper makes distinguish from the research before form the view of property right, regulations of anti-monopoly law and market competition.
