| In the context of economic globalization, international business transactions between the countries become more and more frequently, because of this, the development of the world economy boost huge. But at the same time, more and more commercial disputes are arising from the field, in addition, the features of traditional commercial disputes are very different from traditional commercial disputs. Contemporary commercial disputes are increasingly complex and specialized, which makes the traditional methods of resolving commercial disputes become increasingly obvious deficiencies, so we need more rapid and more economical way to resolve commercial disputes, the mini-tial is the result. Through the introduction of mini-trial, we hope that it will be used to resolve international commercial disputes in the future.This paper uses a comparison argument to show the the necessity and feasibility of mini-trial settlement of commercial disputes. In the first part, the paper intruduce the mini-trial dispute resolution. Part II and Part III discuse the necessity and feasibility of the mini-trial in settlement of commercial disputes. The fourth part, we should pay attention something in the use of mini-trial settlement of commercial disputes, In the process of writing this paper, it use the United States examples to illustrate the superiority of mini-trial, compared with litigation, mediation, arbitration, the paper illustrate the advantages in the use of mini-court settlement of commercial disputes .In this paper, through the introduction of mini-court, I demonstrated the necessity and feasibility in the use of mini-trial of international commercial disputes, I also want to demonstrated that mini-trial has important theoretical and practical value. the paper hope that through this paper, it can make people use the mini-trial to solve complex and specialized controversy, it also hope that through the mini-trial can save the limited economic resources and promote economic efficiency . |
