Research On The Legislative Modal And Legal System Of Charity

Healthy and orderly development of charity need a good legal environment, without good legal environment, the modern sense of charity can never have a strong driving force development. In China, the current legal environment related to charity is not perfect, there is no unified law on charities, to speed up charity legislation and improve the legal system become the fundamental guarantee of the healthy and orderly development of charity.This paper analyzes the problems exist in the development of philanthropy, pointed out the importance of charity legislation, and thus derive that the most important issue of our charity legislation is the choice of legislation model, that is to say having The charity legislation under which legislative model, thus improve the the legal system's issue of charity. The article is divided into six parts:The first part is the basic theory of charity legislation. This section introduces the concept of charity, and then describes the current development of charity in China, and pointed out the problems of China's charity development ,lastly pointing out charity legislation is the important guarantee of the healthy and orderly development of charityThe second part is about the legislative model of charity law and legal system. In this section, the author firstly introduced the the concept and types of legislation patterns and the legal system, and later give a brief summary of the legal system and it's relationship between the legislative model, and finally explained the specific meaning of the socialist legal system with Chinese characteristics.The third part mainly introduces the status of our current charity legislation and issues of legal system. Firstly defined the Legislative status and the legal system of Charity Legislation, subsequently, Point out the inadequacy of this legislative model and this legal systemTte fourth part introduces the extraternitorial charity legislation ,specifically introduced the United Kingdom, the United States and Hong Kong and Taiwan and their charitable Legislation and development of the legal system in order to enlightenment our country's charity legislation.The fifth part take the "Regulations of Jiangsu Province to promote philanthropy" of Jiangsu Province as an example ,introduced the legislative experience of local palce to provide reference for the charity legislation of the whole countryThe sixth part is an assessment of various legislative models, separately introduced the pros and cons of those three legislation models, combined with China's national conditions and to learn from foreign experience, stated the legislation model of the Basic Law and the special law that our charity lagislation should choose, and on this basis point out the path to improve our charity legal system.
