| The cause of charity in China is witnessing a period of rapid developmentaccompanied with the public’s increasing enthusiasm in this aspect. However, in thisprocess, relevant problems and defects are becoming more and more obvious, such as thestructural weakness in charity-related legislation, the indifference among the generalregarding charity, the immaturity of charitable organizations, the defective supervisionsystem and the unsound incentive mechanism etc.. In this dissertation, the author willadopt the analytical method involving qualitative and quantitative measures, thussummarizing the main problems in China’s charity legislation. Meanwhile, the author willput forward feasible and scientific suggestions by learning from foreign well establishedcharity legislation and useful experiences. Specifically, the dissertation consists of sixparts as follows.The first part is introduction, which comprises three aspects, namely the researchbackground and significance, the research overview, the research purpose and method.The second part is an overview concerning China’s charity legislation. In this part,the author clarifies relevant concepts regarding charity legislation, and then illustrates theactual necessity of charity legislation as well as the historical progress of charitablelegislation.The third part is about the current situation and problems of charity legislation inChina. In this part, the author elaborates the status quo of China’s charity legislation on thebasis of analysis from principal component model, the behavior research concerningfactors influencing personal charitable donations and literature review, thus pointing outthe existing loopholes in charity legislation.The fourth part is regarding the charity legislation experience in foreign countries.The author draws the lessons which are practical and feasible for China by means of analyzing some well-accepted and mature legislation in certain developed countries andregions, among which are three aspects, namely comprehensive charity legislationstructure, sound supervision system and well-grounded charity incentive mechanism.The fifth part is mainly about suggestions for charity legislation in China, coveringfour aspects, namely the overall vision, the organization operation system, theestablishment of supervision mechanism and effective incentive system.The sixth part is the conclusion. This part is based on the third and fourth parts,highlighting the building a system which takes guiding charity laws as the mainstay,supplemented by other laws and regulations. The last part also centers on furtherpromoting the operating system of charity organizations, building a sound supervisionmechanism and guaranteeing effective charity incentive system, thus enhancing China’scharity legislations. Finally, limitations and prospects of this research are also presented. |
