| The Community Correction (CC) which has been carried out in China since July 2003 is an execution method different form Prison Correction. It makes prisoners who would be sentenced to public surveillance, declared probation, temporarily serving the sentence outside prison execution, a ruling on parole, or being deprived of political rights serve the sentence in the community, which can help to promote the smooth the prisoner's remobilization process by using various social forces, supervision management and education sources.The CC is discussed from the perspectives of theory and practicing. The discussions on the aspect of theory are mainly concentrated on rectifying laws and humanistic considerations; the discussions on the aspect of practicing, being based on the investigation of CC in Guizhou province are the study of existing problems of executing CC and suggestions of improving the execution of CC on the consideration of special situation of Guizhou province and experiences of other provinces. This paper is consisted of three parts except preface and epilogue outside: The first part is the fundamental discussion of theory on CC and conceptions involved based on previous studies.The second part focuses on the study of existing problems in the execution of CC in Guizhou and analysis of their causes from five aspects——receiving procedures, executive body, corrective measures, carrying out supervision and inspection rewards and punishment.The third part is on the discussion of possible measure on improving the execution of CC in Guizhou province, which is consisted of suggestions on establishing community correction professional team and auxiliary work team, enacting uniform procedural rules, establishing community correction risk evaluation mechanism, strengthening classification correction and psychological treatments, formulating operable inspection rewards and punishment regulations, and improving the execution supervision procuratorates. |
