With the continuous development of social economy, people's minds are more and more open and have more choices of their lifestyle. In such social background, people have gradually weakened the moral value of the marriage, which was very traditional conservative view. The social phenomenon of non-marital cohabitation begins to emerge. But, in China, the legal system is not to adapt major change in marriage and create one vacancy of a legal relationship for the adjustment of non-marital cohabitation. Cohabitation rather than marriage as a non-traditional way of life involves in legal and ethical issues, and many other aspects. Due to non-marital cohabitation, social problems and legal disputes are also increasing nowadays. How to protect legal rights of the members in non-marital cohabitation is become a pressing matter to make non-marital cohabitation adjusted the laws effectively.In the terms of comparative study on theories of extraterritorial legislation, adopting comparative approach, author made comments on comprehensive views of various scholars in this paper. Non-marital cohabitation and formal marriage is regarded as a relationship of independent. From four major areas, the definition, characteristics, the crowd of non-marital cohabitation, and how to identify cohabitation, I try to make clear that the position for non-marital cohabitation in marriage laws in our country and analyze, research the necessity and scope of law on cohabitation and form in lines with our actual needs of the legal relationship theory about non-marital cohabitation. It aims to make recommendations to China's cohabitation law and regulation and is helpful for promoting laws and the reference to the relevant departments.
