Protection For The Citizen's Rights In Public Security Law Enforcement

The law enforcement of the public security organs is an active law enforcement process, which is to govern the national security and social order according to relevant legal norm. It involves the citizens'property rights, as well as citizens'personal rights, to a certain extent, reflecting a nation's civilization level of its legal system. At present, there exist various public security law enforcement behaviors that violate citizens'rights, which seriously impact the construction of a country under the rule of law and of a harmonious society.Learning from the research achievements of some scholars in this field and combining my own work reality, this article gives a deep-going discussion about the civil rights and its current situation, as well as how to better protect the citizens'legal rights in the process of public security law enforcement.This article is divided into four parts:The first part is an overview of the public security law enforcement, which elaborates the concept, the duties and the tenet of police, and summarizes the basic principles for the public security law enforcement and the maintenance of the civic rights.The second part is the theoretical analysis of the civic rights in the public security law enforcement. Based on the study of the relationship of human rights and citizenship, it summarizes the content of citizenship.The third part is an analysis of the present situation of the civic rights in public security law enforcement from the standpoint of census register post and legal post of duty in public security work, revealing the phenomenon of the infringement of citizens'rights in the practical work of public security law enforcement.The fourth part analyzes how to protect the rights of citizens in public security work. It points out that by the constant perfection of the law enforcement basis, improvement of the law enforcement subject's quality, achievement of the glasnost of the law enforcement, observance of the legal principle and proportion principle in the process of law enforcement, enhancement of the law-enforcing and case-handling places construction, and the reinforcement of the law enforcement supervision, to achieve the purpose of protecting the legal rights of citizens.
