As the reform of China's education system is deepening, students legal awareness is continuously improving, the traditional education system received great impact. As "TIAN-YONG case" appeared, the college student management system exposed a series of legal issues. Especially in the area of punishment against college students, there are many problems to be resolved, such as the lack of proceedings, resulting in a serious imbalance between the rights and obligations of universities'and students'. The correct understanding of the legal nature of dispositions and legal regulating the disposition rights against student in university, will help promote the legalization of college students' management and maintain order in school education, and play a positive role in safeguarding the legitimate rights and interests of students.The thesis is composed of five parts. Chapter one is the introduction, the sense of selecting the topic, the current research situation, research methods, the thesis'new ideas are discussed. Chapter two discusses the legal analysis of disposition rights against student in university, including the definition, the value, and the content of disposition rights against student in university, also the legal nature of disposition rights is discussed. Chapter three discusses the legal situation and existing problems of disposition rights against student in university by an empirical analysis. After giving a basic overview of selected research samples, the legality and legitimacy of disposition rights, the disposition rights'influence on student rights, and the legal regulation of disposition rights are analyzed. Chapter four discusses the necessity and valid paths of legal regulation of disposition rights against student in university, two valid paths are established. The final part is the conclusion to the thesis.This thesis discusses the legal regulation of disposition rights against student in university on the basis of theoretical and empirical analysis, concluding that student participation rights and student process rights are two valid paths to the legal regulation of disposition rights against student in university. |
