Rearch On Crime Of Harboring Criminals

In our common daily life, we often saw crimes of harboring criminals in newspapers and television news media. For those harboring cases, we often would hate crimes cases, because of their behavior not only violated the country's legal system, but also is not conducive to the investigation of cases at the same time and it is unfair to the victims because of their behavior so that criminals can not get timely and effective sanctions, so that the victim in the crime could not get timely and effective relief and comfort after being harmed, which was secondary to the psychological harm to the victim. In these cases, there are many cases because relatives of criminals want the criminals to avoid punishment, so take risks to help the criminals to destroy evidence of a crime hidden abandoned in the face of the national judicial investigation, inquiry, for criminals to make false to try to prove that confuse and disturb the direction of the judiciary in the investigation and survey ideas, to conceal their crime for criminals to help the criminals to escape justice. In face of these criminal acts because of harboring suspects and criminals, we both hate their behavior, but also to understand their behavior, more sympathy for their situation. Because human act like this out of love, they choose to have violated state laws and to defy the law for their own loved ones even if they will go to jail together. They hope to be lucky to help their relatives to evade the law. When we are faced with a result that the other relatives in family also broke the law a crime because of the family harboring, leading to the fragmentation of one or even several families, we not just hate and sympathy, but more consider the Crime of Harboring Criminals in the Criminal Law.This paper reviews conviction and punishment for the acts of harboring in the history, as well as provisions on the crime of other countries in the world, starts from four elements of the crime, and analyzes the characteristics of the crime and other related and the difference between similar crimes. About harboring and concealing among relatives, it combines with our history on the provisions of shielding relatives and other countries in the provisions on such crimes, starting from the analysis of human nature among relatives guilty of harboring, and legal punishment provision on relatives guilty for harboring, concealing the murder due to these reasons. For punishment of relatives guilty for harboring, concealing the murder does not meet the criminal penalties for acts of humanity and the concept of Modesty, not cost-effective, there has been the proliferation of criminal law is suspected. This paper holds idea that this behavior is not to be criminalized and thinks that behavior of harboring or concealing among relatives should reduce or waive penalties.
